Terms of Service

Welcome to Crayono ("we," "us," or "our"). By accessing or using our website, applications, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

2. Account Registration

You must create an account to access most features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.

3. AI-Generated Content

The Service uses artificial intelligence to generate coloring page images based on text prompts or uploaded images ("Generated Content"). You acknowledge and agree that:

  • Generated Content is produced by AI models and may not always meet your expectations. We do not guarantee specific results, accuracy, or quality.
  • Generated Content may occasionally resemble existing works, characters, or trademarks. You are solely responsible for reviewing Generated Content before using, publishing, or distributing it.
  • We make no representations that Generated Content is unique, original, or free from third-party intellectual property claims.
  • We reserve the right to filter, refuse, or remove prompts and Generated Content that violate these Terms, our content policies, or applicable law.

4. Content Ownership & License

Your prompts: You retain ownership of the text prompts and images you submit.

Generated Content: Subject to these Terms, we grant you a non-exclusive, worldwide license to use, download, print, and share Generated Content for personal, non-commercial purposes. Users on a Pro tier receive an additional license for commercial use of their Generated Content, subject to the restrictions in Section 5.

Community Gallery: By making Generated Content public (non-private), you grant us and other users a non-exclusive, royalty-free license to display, remix, and create derivative works from your public Generated Content within the Service.

Our rights: You grant us a non-exclusive, worldwide, royalty-free license to use, store, process, display, and reproduce your submitted content (prompts, uploaded images, Generated Content) solely to operate, improve, and promote the Service.

5. Prohibited Content & Conduct

You agree not to use the Service to:

  • Generate content depicting real people without their consent
  • Generate content that is sexually explicit, violent, hateful, or harmful to minors
  • Infringe or misappropriate any third-party intellectual property, including copyrighted characters, trademarks, or logos
  • Attempt to circumvent content filters or safety systems
  • Use automated systems, bots, or scrapers to access the Service
  • Resell, sublicense, or redistribute the Service itself
  • Interfere with or disrupt the Service or its infrastructure
  • Violate any applicable law or regulation

We reserve the right to suspend or terminate your account and remove content at our sole discretion, without prior notice, for any violation of these Terms.

6. Credits, Subscriptions & Payments

  • Free credits: Free-tier users receive a limited number of credits per week. Free credits reset weekly (every Monday at midnight UTC) and do not accumulate or carry over. Free credits have no monetary value and are not redeemable for cash.
  • Purchased credits: Credits purchased through top-up packs or bundles do not expire. Purchased credits are non-refundable except as required by applicable law.
  • Subscriptions: Subscription plans renew automatically at the end of each billing period. Monthly credits included with subscriptions reset each billing cycle and do not roll over. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Price changes: We may change pricing at any time. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their account.
  • Refunds: Subscription fees and credit purchases are generally non-refundable. If you believe a charge was made in error, contact us within 14 days. Refund requests are handled on a case-by-case basis.

7. Uploaded Images

The "Image to Coloring Page" feature allows you to upload photographs or images. By uploading an image, you represent that you own the image or have the necessary rights to use it. We process uploaded images solely to generate your coloring page and do not use them for any other purpose. Uploaded images may be temporarily stored for processing and are not retained after generation is complete.

8. Private Mode

The private mode feature prevents your Generated Content from appearing in the community gallery. However, we may still access and review private content for the purposes of enforcing these Terms, responding to legal requests, or ensuring the safety and integrity of the Service.

9. Intellectual Property

The Service, including its design, code, branding, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

10. DMCA & Copyright Claims

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please submit a notice to our designated DMCA agent as described on our DMCA page. We will respond to valid notices in accordance with the Digital Millennium Copyright Act. DMCA.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE FROM INTELLECTUAL PROPERTY CLAIMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Crayono and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your Generated Content or prompts; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Termination

We may suspend or terminate your account at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Unused credits (free or purchased) are forfeited upon termination for cause. Sections 4, 11, 12, 13, and 15 survive termination.

15. Governing Law & Disputes

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Montreal, Quebec, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Crayono regarding the Service.

18. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
